I heard that the ICO's office has written:-
"The wording used by many forces in the 'Evidence of character' section,
which states that exercising your subject access rights "...will not provide
you with a Certificate of Good Conduct" or "Police Clearance Certificate"
could be misleading. The result of a police subject access request is
commonly accepted for this purposes by low-risk employers who are presently
unable to use CRB procedures and by overseas visa granting and immigration
authorities."
Which to me seems, in respect of criminal records, antithetical to the DPA
1998 s.56 and the FOI s.30 - 32.

Sad that the DPA frequently results in individual privacy so often and
easily becoming embroiled in focused demands and interests as illustrated by
the three examples above. Unfortunate when the ICO's office also, without
challenge, seem to fall into the trap of focused interpretations.
