But surely backups of servers will still be in electronic format and so
still relevant as per the statement made?

I think there's another important issue at stake. The piece states
"there is no obligation on a data controller to disclose to a data
subject data that used to be held in electronic format but no longer is.
A data controller could only be required to provide information that it
held at the time of the request."
I would interpret that to mean that it is not necessary to search
back-ups of e-mail servers etc., when conducting searches in response to
data subject access requests.
Anybody disagree?

So we might as well not have bothered extending Data Protection to
manual
records, since in fact the Data Subject has almost no right of access
and
people can continue to avoid data protection responsibilities by holding
information on paper - or even by transferring it from computer to paper
records.
Is this really what the Directive intended?
