I always take the view that one must be as controversial as possible in
order to apply common sense. Sexual misadventures are probably the most
provocative one can be, especially when made personal, and the reaction then
often alters subtly :)

I know you're trying to be provocative with the extreme nature of your
"hypothetical" case, which I think is good in the sense that I believe it
livens up what might be an otherwise dull topic. However, my comments do
only relate to the details of this actual case. In your hypothetical case,
there is clearly considerable damage which could result not only to myself
but to other third parties. Of course, being the
nicely-brought-up-soon-to-married young(ish) lady that I am, I couldn't

I think if details of a disciplinary case against me had significantly
affected the lives of x million Londoners, I would accept that it was in the
public interest for them to know about it. So I can put my hand on heart
and say that I could answer your deciding question in the positive.
We're
also assuming that this information was made available to the Press without
the consent of the individual concerned. I've certainly not seen any
details in the press that a complaint has been made by either the individual
concerned or his Union in relation to infringement of his data protection
rights.

Ummm... not sure I agree, even though I was one of the thousands who
suffered.
I think I would apply the simple test that I find particularly effective
when dealing with difficult colleagues who are arguing about restrictions
the company's DP manager and I sometimes have to apply to the proposed use
of data. The test consists of one question: "Would you be happy for data
about YOU to be treated in this way?".

I would say the exemption for "journalistic purposes" would have applied.
After all it was partly thanks to this guy's case that whole sections of the
London Underground came to a grinding halt (even more so than usual) so I
think you could certainly argue that the public had a right to know the
details of the case. But in light of Naomi Campbell's verdict last week,
who knows what the law is this week as opposed to last!!
