For public authorities operating under FoIA one of the early questions to
be asked about any request for information is will be whether it needs to
be dealt with under DPA, EIR or FoIA - or whether it is a mixture of two of
these or even all three.
Personally, I think that it will be easier to differentiate between DPA and
EIR/FoIA rather than deciding whether a request for non-personal
information must be dealt with under EIR, FoIA or both.
