I would say, just for the sake of argument, that it doesn't need a Schedule
3 condition. I see the point - if you drink beer or eat pies in moderation,
the effect on your health will not be that bad. However, smoking is thought
to have a negative effect on health even when used as intended, or in
moderation.
Nevertheless, despite the many problems that smoking might give you, I don't
see that knowing whether someone smokes tells you anything concrete about
their health. To give a silly but hopefully useful example, I never take the
lift in the Town Hall, I always use the stairs. However, my health is
definitely not as good as some of the svelte individuals who do use the
lift. So knowing that I act in a certain healthy way doesn't tell you
anything about my health.
Having said all of that, I would wonder whether you could justify asking the
question at all - what's the schedule 2 condition?
