Also, what I meant was from a DP point of view how do you inform the offender you are taking their photo "Hey, smile for the camera please we want people to know it is definitely you"....or does the crime prevention/any ASBO jurisdiction cover this?

My understanding is that RIPA is only concerned with interception of
communications in the course of transmission in relation to a public
postal service, or a public telecommunications system. It does not cover
what a camera phone is used to take pictures of.
