Now we get to the fun. Designing a web site where you have (effectively) to
sign a contract before you allow your IP address, browser footprint and
myriad other stuff to be left "before it is left" is an amusing technical
conundrum. Because the browser leaves a huge payload of information by the
fact of the page opening.
If it is "Sufficient notice to despatch a letter to a surface mail
recipient's last known address" then it is sufficient notice to despatch
same to the email recipient's last known address. But, tongue in cheek,
what if the email recipient has said "No 'stuff' by email please!"
If I now send the contractual email "our privacy policy has changed" to the
objecting recipient s/he will say "I *told* you never to email me!" And
they are quite often impolite! I risk losing a valued potential customer by
doing something I am contractually obligated to do!
A year or two ago I worked for a company who delivered their products in
part by email under the contract to supply "stuff". I had to be involved in
cases where imbecilic recipients said "This is Spam. Remove me and never
send this again" when it was the "stuff" they had bought and *had* to be
delivered that way!

The only logical way of staying compliant is therefore to instigate a
positive response return device to prove that your data subject has read,
understood and agreed to your changes (read-receipt would not cut it, as it
only indicates read, not read and understood).
Funnily enough, I have yet to see anyone doing this!
