Rosemary,
There's a statement about data protection on the JISC Plagiarism service pages at: http://online.northumbria.ac.uk/faculties/art/information_studies/Imri/Jiscpas/site/adv_data.asp
In case that doesn't work (I'm never sure which are static and which dynamic URLs), go to the service home page at
http://online.northumbria.ac.uk/faculties/art/information_studies/Imri/Jiscpas/site/jiscpas.asp
Then click on "Detection Service" on the left hand menu bar and you should get a link to "Data Protection Statement" on the right hand side.

Subject: Plaigarism Detection and Data Protection
I have received an email suggesting that data protection prevents
Universities from using a plagiarism detection service (see
http://online.northumbria.ac.uk/faculties/art/information_studies/Imri/J
iscp
as/site/detect.asp) to detect plagiarised student courseworks. What do
list
members think? Does the problem lie in the construction of the database
from
previously submitted student work? Would consent not overcome this
problem?
" Just to let you know that the University is well aware of the
plagiarism
problem. In October last year it investigated but rejected (for
apparently sound reasons) the possibility of using a plagiarism
detection service (www.submit.ac.uk) which is based on Turnitin. There
were concerns that the use of such a service would raise significant
problems, including data protection implications."
