It beggars belief that such action could have been taken resulting in an
individual receiving notification of a terminal illness within the confines
of a witness box whilst under examination by counsel.
Given that exemptions could be argued for under the DPA, and that everybody
will have heavy hearts over the matter, at the end of the day the data
subject has been seriously let down by whatever legal protections should
have been available.
What legal protections for an individuals data can provide protection in
such circumstances?
Or is it all down to the chance sensitivity of members of the group who
control the data?
