I think the trouble is 100% for total failure. What matters is whether TICO
will enforce. You did mean controller, didn't you?
"If you're going to fail with an SAR then don't process data" seems a
reasonable concept.

Yes, but once the 40 days are up, is the data subject in any more
theoretical trouble with TICO if he fails completely, than if he issues the
response late?
