Sorry but I cannot agree with Tony. Just because something has become used
for another purpose does not change what the charge was levied for in the
first place, unless legislation has changed the purpose and I am not aware
of this. Whether or not the level of funding is determined by the government
or not, I do not believe the licence charge falls under the definition of a
tax.
I agree with Ian B's point however.

II would say that it is a tax. It is many years since it has had any
relationship to the amount of money that the BBC get. It is now just put
into tye general government pot and they decide separately THE LEVEL OF bbc
FINANCE.

I would argue that it is not a tax (personal feelings for this abhorrent
charge aside) and that it is a charge placed on the public to support a
government "controlled" organisation rather than a government department.
I would say therefore that section 29(c) is not valid and that the TV
licence people have no right to such information.
Also I would ask what use the information will be? Do you hold whether or
not the student has a TV? Can this information be used to determine that the
student watches TV owned by them? I think not. Let them use their detector
vans and do the job themselves is my opinion.

I would very much welcome any comments on the following (Friday) question I
was asked at a recent training session. I've had a look at the list
archives but can't find any discussion on this.
Should we provide any personal data about students if we receive a request
from the TV licence enforcement people?
My initial thought is that we could under section 29(c) if they are asking
for the reason of "...collection of any tax or duty or of any other
imposition of a similar nature" but is a TV licence fee such a tax, duty or
other imposition?
