Advice needed fast please.
Scenario:
13yr old male child (lets call him 'John Smith') gets on bus. Other male
children for whatever reason attack the female bus driver. John Smith hears
the fracas and as he knows the boys attacking the bus driver entrers the
fray to try and push his 'friends' off the driver. Meanwhile all this is
being caught on CCTV.
Investigation is started and 'John Smith' is suspended from school for 2
days. Investigations reveal that 'John Smith' is not guilty and returns to
school.
A few days later, the CCTV imamges of the incident is shown to the whole
school during assembly to reiterate the fact - how not to behave / this
behaviour will not be tolerated - you know, 'teach them a lesson'.
The CCTV images blatently show the faces of all those involved in the
incident including 'John Smiths'.'John Smith' is upset and embarrassed
about the fact that his face has been shown to all.
Mother of 'John Smith' wants to know where her son stands in terms of Data
Protection. She is sure that somewhere along the line the Act has been
breached, as no one asked for her or her son's permission before his image
was shown to all and sundry at his school.
What advice can I give her? Has she got a case? I would have thought so,
but I am not too sure.
