Many further references are available via
http://www.google.com/search?sourceid=navclient&ie=UTF-8&q=%22Spring+v%2E+Gu
ardian+Assurance%22 some of which require membership of organisations to be
accessed.

You will find the case here:
http://oxcheps.new.ox.ac.uk/casebook/Resources/SPRING_1%20DOC.pdf
I think we need a qualified legal person to comment on two aspects:
"Qualified Privilege, the definition"
And
"Case law in 1995: How does that affect a law passed in 1998?"

I was given to understand that the Data Subject could get access to job
references from the recipient.
Can anyone comment on the reply received from the recipient :-
Quote from reply: exemption to disclose of "qualified privilege" that
applies in law to employment references (See for example Spring v.
Guardian Assurance [1993] IRLR 122 CA).
and where can I get access to this case to read up.
Regards
Arthur
