We had a case something like this a while ago. The data subject knew that
we had two references because he had been told by the department concerned
that that was the reason for a contract not being given to him. Can't
remember all the details but at least one of the references was hand
written and the data subject would have realised who had supplied it if he
had been given a photocopy.
After discussing the matter with one of our solicitors we decided that the
department would type out the contents of both references, without
identifying who had sent which, and write to the data subject enclosing the
typed copy. We have heard nothing since.
Regards,
Graham
