Poland's law looks much like the Hungarian statute and the Directive and the DPA there is very, very tough. I'm puzzled that Poland hasn't been found adequate, but I suppose they simply haven't approached the Commission for a ruling, as did Argentina and Canada.

Principle 8 says that transfer depends on adequate protection only to
countries outside the EEA . If they're in the EEA the level of protection
is - one must assume - irrelevant. While the accession countries are all
supposed to be putting the whole canon of EU law into place for 1 May, I
can't see Data Protection being their top priority. Of the accession
countries only Hungary has previously been EC approved, but if the others
don't get their acts together, that's probably tough.
