If it's research data then retention may not be an issue - under section 33
(DPA) the research exemption applies to principle 5 (and principle 2 and
subject access provisions), so there is a chance that the data could be held
indefinitely unless the data was used to help make decisions that relate to
the individual(s) whose personal data is being processed

The Department Of Health has a guidance circular on the management of all
NHS records, including health/medical records. It is available online here:
http://www.doh.gov.uk/nhsexec/manrec.htm
Look in the "retention and disposal" area for specific guidance on specific
types of records. The section "Hospital Patient Case Records" deals with
medical records. The same principles should also apply to non-NHS medical
records.
You might also find the following guidance useful, produced by the Health
Archives Group.
"Hospital Patient Case Records: a guide to their retention and disposal"
http://www.pro.gov.uk/archives/standards/hospitalrecords.htm
Finally, the Society of Archivists www.archives.org.uk and Health Archives
Group will shortly be publishing some guidance on access to medical records
under FOI. I am sure that when this is published an announcement will be
made to this group.
Hope this helps,
Catherine
