Would it be an accurate factual representation of many circumstances to
state that courts do make use of private commercial businesses for warrant
enforcement (some of whom may also be private investigators)
Legal advice received in the past regarding non payment of fine warrants
indicated that disclosures where necessary should be made to the clerk of
the courts, who would pass the necessary information to the relevant warrant
enforcer. It would seem apparent that advice may vary dependant upon the
relationship between the data controller in question and the warrant.
I quite agree that the importance of obtaining legal advice from an
appropriately trained and qualified person is very high as the validity of
some warrants may be challenged.
The postings going through this list admirably indicate the equal importance
in increasing the clarity of knowledge of all DPA practitioners who may be
approached for disclosure advice.
