Indeed, and I have argued long and hard that "being nice to the police"
is not a legitimate reason for long retention periods, beyond the
original business purpose. So the government went and passed the
Anti-terrorism Crime and Security Act, which attempts to fix that
conundrum, but they bungled it :-(

I was speculating that one could attempt to correlate the actual police
requests with the discovered availability of the data on the day. But
that's spoilt by the police moderating their requests for older data, so
it wouldn't show up as "failures".

There has been enormous amounts of debate about ATCS, in the UK. The
lack of consultation or debate about the UK's recent EU proposals is of
great concern to those whose day-job is worrying about such matters.
