Apologies if this has been asked before, but I wonder if anyone can help me
with the following?;
Central Govt (Dept of Health) are driving the Identification, Referral and
Tracking Initiative, which (as I understand it) involves sharing information
in order to offer better protection to children at risk of social exclusion.
This means linking up (at least) Social Services, Education, Connexions,
Youth Offending Services, Primary Care Trusts but how they will actually
practically use this joined information is not yet clear. Our Education
Directorate has brought this to my attention for DP advice before they
embark on the project for Worcestershire.
The DfES, together with advice from the OIC, has compiled a fair obtaining
notice, plus a request for consent, for the information from schools to be
shared with Connexions. This states that the names and addresses of pupils
and parents must be provided to Connexions in any event (Legal requirement
under the Learning and Skills Act 2000 apparently), but that pupils/parents
can choose to opt out of any more information being shared with connexions.
If we used this in WCC, we can then flag up on our system that the parent
has opted out ands the information will not be passed.
As for the other agencies, I am not aware of a statutory basis for any of
this sharing; I get the impression it's another one of these Government
driven targets for joining up services, with no regard to Data Protection,
and that local authorities will be told to take 'local decisions'. Hmmm.
Without a statutory basis, I'm not convinced legitimate interests wouldn't
affect the freedoms of the data subjects or that it would be in their vital
interests either. Are we left with consent?
Any advice would be appreciated, particularly from anyone who has specific
experience of this in their authority.....
