The Race Relations Amendment Act 2000 placed a duty on Public Authorities to
promote race equality and eliminate racial discrimination. Therefore more
monitoring has to take place to analyse take up of services etc to see
whether there is an adverse impact on ethnic minorities in respect of
service provision, employment, training and in education. The Act details in
which areas monitoring must take place and advocates areas where authorities
should be carrying out impact assessments to determine whether policies and
procedures are complying with the Act. We will probably see this kind of
monitoring taking place in a wide range of areas.

As long as one can meet both sets of conditions, there's no ban on asking
for ethnic origin. It's like all sensitive information - the question is
whether is it necessary to gather the information to do the job, and if so,
can you justify it under the Act, through a legal obligation or by getting
active consent? I have seen some forms which look like they haven't entirely
been thought through, as if having information about ethnic origin would be
handy or interesting, rather than because it can be justified.
