It's a bad week already and only came back yesterday!! Anyway, hope someone
out there can help:
The Council sold its housing stock to a Housing Association (which consists
of former Council employees). An agreement was reached whereby the Council
would act as a data processor for the Housing Association for collection of
rents only for a couple of years. Here come the problems although
admittedly I believe they are Council Tax Regs which stop us from so doing:
A tenant of the Housing Assoc informs the Council that they wish their
Council Tax address changed and it is then discovered that there is either a
debit/credit attached to their previous house with the Housing Assoc - we
can't use that information as the Housing Association is a different Data
Controller to the Council whereas previously we did use that information. I
believe the Council is concerned as acting as data processors for the
Housing Association we would have to pay tracing agencies an amount of money
to trace the people even although we as a Council, through Council Tax knew
where the person had moved to - the concern is protecting the public purse
dependant on what has been agreed with the Housing Assoc.
There are about another 6 issues concerning Council Tax and also someone
moving address and only informing the Housing Association but correct me if
I am wrong - it is reasonable to assume that the Council Tax Regs prevent us
from disclosing this information. I am firmly of that belief as if we were
not data processors for the Housing Association we would not be aware of
these changes to the personal information.
Anyone with past experiences or help would be greatly appreciated.
