My view is that the council might have the right to do this under health
and safety legislation if they are responsible for public health and
safety and for checking building sites etc. I would ask the question.
Might need the evidence to present to the company's management if they
have already been warned about H&S breaches and it would be up to the
company to discipline their staff for blatant disregard of company
rules.

I have been asked for health & safety purposes if it would be Ok to
video on
a particular site in order to do an audit of the site e.g. to identify
staff
not wearing personal protective equipment or vehicles making unsafe
maneouvres. I have been told that any photos/video footage captured
would
not be used for disciplinary purposes...hmmm...
My question is - is this legal - or is it a bit like e-mail monitoring
- you
would have to inform individuals that you would in fact be videoing
the
site? I also have reservations as to any disciplinary proceedings as
if
someone was told he/she had not been wearing a helmet and repeatedly
this
happened surely disciplinary would have to come into the matter at
some
point...
I would have thought that this would have been part of a contract but
obviously not...
Any views again greatly appreciated....
