Whoever collected the personal information, presumably for the data subjects personal healthcare, would need to have informed the data subject that their personal data may be used for research, otherwise Fair Processing would not be satisfied.

In a letter to The Times 22 May 2001 the Information Commissioner makes it clear that although personal data may be used for the purposes of medical research without the patient’s explicit consent it is still necessary that “patients are given a clear explanation of the purposes for which it is intended to use their data”.
I am trying to figure out why this should be so given that s.35 exempts those engaged in research from the second data protection principle. I had understood the second principle (probably wrongly) to forbid use of personal data for a collateral purpose without notification of the data subject. If that prohibition is lifted...
Any help is much appreciated.
