Tony,
My HR guy phoned Inland Revenue on this and was told foreign students
could apply for a Nat Insur No at any time.
He still wont budge on NINO being excessive information on application
forms. He cites as argument "all other companies in the UK ask for it"
He claims he wants to know that applicants can legally work here
before he interviews them so as not to waste his time ??

You could also point out that they could be leaving themselves open to a claim
for race discrimination. In particular, overseas students (who are allowed to
work here) will not be issued with an NI No. until they have obtained a job.

I amin dispute with my HR section. They intend to request national
insurance numbers on employment application forms. I have stated that we
can not ask for NI on application forms for the simple reason we would then
be collecting excessive information. Everyone who "applied" would be
providing this data. We can only ask it of successful applicants.
