The commissioner's advice is typically too basic, it says that if the CSA
has legal powers to request the data not contravention of the DPA 1998
occurs, this is obviously the case s.35(1). The problem is the way in
which
the CSA request the data they state and I doubt that they have a right to
any data they want! in extremes then do they have the right to know a
missing parents care plan from Social Services?
The fact remains that if this is the case the CSA should state their
powers,
quoting the Act and Section used, together with a FULL explanation and
description of application, this should also state the exemption used,
unless a DPO has this data how can they be sure that fishing exercises are
not taking place?
Perhaps NADPO could contact the CSA at a national level?

I can;t see why they shouldn't still have to quote the relevant powers even
if these are so wide ranging they can pretty much ask what they like from
you.

Morning All
I have been dealing with requests for data from the CSA lately, firstly
their requests were in an unstructured manner and thus refused. Now they
tell me that all LA's must supply any data they request without question, I
have asked them to apply a DP exemption (assuming its s.35(1) ). They are
totally unaware of their requirements in this area, whenever they are asked
for their legal powers for demanding the data, their answers are
unsatisfactory - on occasions threatening myself and other colleagues in
the
West Midlands area with imprisonment if we fail to comply, without ever
quoting legal powers (i.e. Act, section and application).
Has anyone else managed in another area to get a solid response to the
question of legal powers and exemption applied?
Maybe I can resolve this before I have to reply to Jiscmail of HMP Letter
headed paper.
