At this college, in common with many others in the UK we take a digital
image of each student for use on their ID card. They are advised that their
image is to be used for ID Card which doubles up as a photocopier
swipe/charge card.
The Dept for Education and Skills (DfES) has recently employed Capita to
issue the Connexions card (this is associated with the Careers Service) to
all school and College students. They have asked us to provide them with the
personal data of each student AND the image which will go on to the
Connexions Card. All colleges currently are required to submit a
considerable amount of personal data on each student to the Learning and
Skills Council(LSC) who in turn provide any or all of that data to the DfES.
So to be asked by Capita, who have been contracted by the DfES to collect
this data and issue Connexions Cards, to send them this data is not a
problem.
Here's the 'BUT'.
We do not send the image to the LSC or the DfES with any personal data on a
student and we have only informed students that their image will be used for
ID cards.
My view is that we cannot send a students image to LSC or DfES unless we
have previously informed the student of this intended use or we subsequently
ask each student for their consent to do so ( this would be about 9-10000
students).
What is the view of those of you more knowledgable than myself re Data
Protection?
