By default a member of staff in a 'one-stop shop' has to have access to many
different areas of data; Council Tax, Benefits, Electoral Register, Refuse
Collection, etc. Plus data from other partners; Health, Police, etc.
Question: If a member of staff discovers a possible fraud offence after
accessing, for example, a persons benefit record and then their health
record (by request of the data subject), could the information be used to
start an investigation?
The personal data for the systems will normally have been collected in
isolation - therefore the data subject will be under the impression that it
will be used for that purpose only (detection and prevention of fraud might
also be mentioned in the DP notice). However, in this case, the information
has been discovered because of the operational requirements of a 'one-stop
shop' and not because fraud was suspected in the first place.
My view at the moment is that 'one-stop shops' can operate because they use
the data as notified, i.e. for Council Tax admin, Benefits admin, etc. But
Principle 2 would be broken if the data began to be matched in the way
described above.
