I know of one case where a child was photographed doing some hand painting in
a primary school. The photograph was annotated giving the name of the
school, the class and the child's name under the very clear picture. As she
was in danger of being kidnapped by her estranged father the mother removed
her from the school, changed her physical appearance (previously the father
didn't even know which are she had been officially moved to) and a great deal
of distress was caused. The supply teacher had given permission for the
picture to be taken but the legal guardian had not been asked. The child
would not have been aware of her situation nor was she old enough to have
given consent.
As most of us are not in the same position we sometimes find it hard to
believe or understand the distress that can be caused in these (thankfully
rare) cases. I would say that obtaining parental consent is the best option,
particularly if the child is under 14 (the press should adhere to the code of
practice saying something similar).
