Oh so many possibilities here. The question is whether the student is
eligible for student support since DSA follows on from that. I can think
of a number of possibilities.
If the student is British and has been ordinarily resident (ie with a
settled purpose, not for educational reasons etc etc) for three years in
the UK then the status of her husband is irrelevant. It is unlikely that
she would have lost her ordinary residence because of a two year absence
so long ago.
If the student is a EEC national but has got settled status within the UK
then again her husbands status is irrelevant - she simply applies for
support in her own right.
If neither the above apply then there is still a possibility that she is
eligible for support as the wife of a migrant worker.
Who informed her of her ineligibility? Has she made formal application
for support through her LEA?

A student has been informed that she is not eligible for UK student
awards
because her husband is working abroad and is resident in France. The
student, who is British, has always been resident in UK except 2 years
abroad in 1986-88, and has children at school here. They spend some of
their holidays with her husband in France, but do not live there.
The student is dyslexic and needs additional learning support. While we
can
offer a limited amount of free support, we would like to explore whether
she
could be eligible for DSA (or EEC equivalent).
