Elizabeth,
This depends on the contract with the tutor. If the contract incorporated
cancellation charges, then it could be argued that the student was 'obliged'
to incur the cancellation charges for non-attendance. If the student had to
adopt the contract to receive the service, then a cancellation charge can
appropriately and legally be charged to the DSA.
The LEA has final say on what it will approve as 'reasonable', so if
cancellation charges were incurred at a high level, on many occasions, we'd
have to have a close look.
