'Time limits on litigation' isn't terribly helpful. After a while people will quote this as absolute without really understanding what the reasoning behind it is. Is it right to assume it is the 3 month time limit on applications to an employment tribunal plus a bit longer because in exceptional circumstances this time limit can be extended? Or is it something completely different? Without the detail how can organisations assess the risk?

The information commissioners office have recently said that they will look into any cases where interview notes have been destroyed in breach of any corporate guidelines or codes of practice where it looks as if that destruction was in order to prevent subject access.
The JISC Data Protection Code of Practice for the FE and HE sectors recommends that interview notes are kept "At least 6 months from the date of the interviews" - the reason - Time limits on litigation.
