Paula, that would be Schedule 2 Para 17 you're looking for:
17.-(1) Regulations under this Schedule may include provision that an
authority
(a) may supply relevant information to any person who requests it for a
purpose not relating to Part I or II of this Act; and
(b) may charge a prescribed fee for supplying the information.
(2) For the purposes of sub-paragraph (1) above information is
relevant information if
(a) it was obtained by the authority for the purpose of carrying out its
functions under Part I or II of this Act; and
(b) it is not personal information.
(3) For the purposes of sub-paragraph (2) above personal information
is information which relates to an individual (living or dead) who can be
identified from that information or from that and other information supplied
to any person by the authority; and personal information includes any
expression of opinion about the individual and any indication of the
intentions of any person in respect of the individual.
I think it was written like this because of the (then) government's need to
reassure the public that Council Tax was not a 'poll tax' and data gathered
for CT would not be used to persecute the 'disappeared' over non-payment /
arrears of the much-hated Community Charge. I also suspect that is why it
hasn't been changed despite numerous representations to successive
governments.
Para 18 then covers the use by charging authorities (for CT purposes) of
information gathered for other purposes as long as there is no prohibition
within the enactment under which the information was originally obtained.
Thus allowing CT to obtain information from numerous statutory sources
despite being prohibited from sharing on a reciprocal basis (except with
Registrars of Births, Deaths & Marriages and with Electoral Registration
Officers under the Representation of the Peoples Act 2000).
