Hello Doreen
Unfortunately there is no cut-off date for subject access - personal data
held by the Council, including Social Services, no matter how old, must be
provided in response to a SAR.
This issue was discussed at a recent meeting of our North West DP Officers
Group - some DPO's had been obliged to respond to SAR's with boxes full of
info going back to the year dot. Peter Bloomfield's (OIC) advice was that
Councils should weed out and destroy old personal data they no longer need,
to avoid the need to provide large volumes of unnecessary, out of date
information in response to SAR's. However, if the information is retained,
it must be included in the SAR response.

Subject: Access to Social Services Files
Hi
As we all know - Access to Personal Files Act 1987 has been repealed by the
Data Protection Act 1998. I am presently trying to revamp the Open Access
Policy in accordance with Data Protection. The previous policy states that
it only related to information recorded after 1 April 1989. I presume that
that is now superseded and it should relate to all information both
electronic and paper records held on file - or does it only go back to 1984?
Help???
