Within the last month I have had two separate subject access requests to
view CCTV relating to car accidents on Campus.
For the first, both parties initially agreed and I was prepared to allow the
viewing on that basis. Subsequently, one party withdrew their consent, and
the other felt it was a matter for the insurance companies and suspended
their subject access request. The tape is held pending the outcome, and we
could still be faced with a decision on releasing that information.
The second incident is where an individual wants to see the tapes covering a
two day period, as they think someone has dented their car during that
period. In this case, we are firstly seeing whether there is any relevant
information on the tapes. If not, problem solved!
If there is, do we have to balance the rights of the the parties involved,
seek consent, or can we rely on a Section 35 exemption? If the latter,
should we expect to see evidence of likely legal proceedings?
