The first scenario:
1. If there is a risk that by disclosing the information would be
likely to prejudice the carrying out of social services functions or would
be likely to cause serious harm to the physical/mental health condition of
the data subject or another person disclosure may not be necessary. I
would have thought in this scenario a criminal investigation was underway in
view of the seriousness of the claim and surely some protection plan is in
place for the data subject and by disclosing the information would be likely
to jeopardise the plan. I am surprised that he is obtaining access to the
system in view of the seriousness of the situation. I would suggest that
access should be stopped immediately - otherwise how can any reasonable
investigations be carried out if he is one step ahead by gaining access to
all the information.
2. In this scenario we surely owe a duty of confidentiality to the data
subject and her wishes should be respected. Can it not be that access to
that particular case is only given to essential staff.
Others may have different views but this would be my first interpretation of
the scenario.
