Once FoI access requests come into force they will allow access to
information held by public authorities, if the information is not held at
the time of the request there is no access right. As I see it, if there is
an audit or legal requirement to keep data for a specified time the
retention period should be based on the longer of these requirements, if
not a justifiable operational retention period should be identified and
adhered to.
