With my tongue firmly in my cheek...
Ian suggests that using town centre CCTV to detect staff falsely claiming to
be sick when they aren't is a personnel matter. How about a criminal matter
as well (and hence eligible for S29 exemption)? The crime? - obtaining money
(sick pay) by deception (pretending to be sick).

Am I just getting cynical or does Duncan aim to wind us up each week
with a
tale of "how to get round the Act in a dodgy way"?
In this case, as he well knows, CCTV is not used SOLELY for crime
detection
and prevention. In many cases, councils use the system to reduce
civil
offences such as disorder (Crime and Disorder Act 1998 - which
includes
anti-social behaviour) and in some cases employers use it for
internal
disciplinary matters as well as crime perpetrated by staff.
In some cases town centre footage is used for personnel matters when
staff on
the sick are caught on camera, or for contract compliance where
contractors
are not sweeping the streets properly. Obviously the signs
indicating these
purposes would be huge and impractical so many would choose to
include such
uses in the contract of the person being watched.
Without signage, although perhaps not a breach of DPA first
principle if the
images are just used for crime purposes, there could be a breach of
human
rights, RIPA and PACE regulations to name but a few of the rules
DPOs have to
consider as well as DPA - if only it were that simple!
