They are unlikely to be sensitive unless the photographs are distributed by
the police to local shops as picture of "known thieves" or some other
indicator attached to the photograph (or list accompanying the photos) which
would fall into the definition in the Act.
Even if they are not sensitive data, you may still need consent in order for
their distribution to be "fair" under the first principle.
