exists.)
Who is the data controller of an e-mail? According to INTERNET ISPs' the
originator or recipient is.
Accepting that view, and with JISCMAIL.AC.UK being a recipient as well as an
originator they must be the data controller of the e-mails sent to and sent
by them.
That being so, what is adequate relevant and not excessive for the purpose
of maintaining an archive 'for the purpose the archive is maintained'?....
Some circularity then begins to appear in the argument as there may be more
than one purpose for the archive.
If the purpose regards generic data protection, or any other issue, then the
majority of newsgroup of mail base type functions, by retaining the header
information, rather than merely the body of the text, may be breaching
principle.
If the purpose is an historical record or for academic research then other
issues arise.
And that's before you start to think about how long it is necessary for the
purpose.
How do providers such as Google Groups then sit?
