You categorise me as complaining "to the wrong people", which is
interesting, and I can see why you might take that view. However the people
who participate in this list do so freely and willingly, and I am not
complaining, but simply stating firmly that I believe that this list is not
compliant, and stating it both to the list owner and the participants.

I do not recall being asked my opinion, nor do I believe that an opinion is
relevant. If I say today "I do not give permission for my contact details
to be divulged in the archives," then what happens?

My understanding of the DP Act 1998 means that ALL references to me in the
archives must be deleted, OR the archive must be protected such that my
agreement, which I may choose to give, that LIST members may see my details
and only listmembers is honoured.

Ignoring whether my contributions to the list have any value (which is not
the point at stake here) the former option means either that I must choose
to remain a recipient of information and only comment if I choose to from a
pseudonym and fake email address, or that I must be expelled (seemingly at
my request) from the list. The latter option is surely preferable, since it
allows attributable remarks to be made in "comfort"

I believe that we are incorrect in assuming that we can "vote" (there has
been no vote to my knowledge here) our way around data protection
legislation. It seems like a motor club voting itself the e power to
ignore speed limits with impunity.

That something is "difficult" or "not wished for" does not remove the
requirement to comply. No-one has yet convinced me that this list is
compliant with the law.

I am sure we understand your point, but the decision that Sally came to was
made after asking ALL the users their opinion. Given the decision that
Sally came to it would seem that the majority of us said we wanted the list
to be open - you can't object to that.

JISCMail is not ideal but to change it is beyond the power of anyone on this
list (save Sally) so you're complaining to the wrong people. If you really
do not think that the list conforms to DPA, raise it with JISC or the OIC.

I know that getting junk is a bit of a hassle, but its not fatal and many
people who use the list are not permitted to subcscribe to it and can only
ever use the archives. Bearing in mind that the success of a listserv is
founded on altruism (one wastes ones own time and resources helping others),
is it fair to condemn these people just because they have crappy email
policies at work or inferior servers that can't cope with large amounts of
mail?

I am sure you're not alone but that doesn't equate to you being in the
majority. I speak for myself and would never presume I am speaking for the
silent majority.
