It's Friday, it IS a recipe for disaster and the scary part is that some data
sharing protocols have been written from the point of view of the duty with
little regard for the bit that says "Without prejudice to any other
obligation imposed on it . . " including the obligations under the DPA98.
The guidance from the OIC and the Home Office make it perfectly clear that
data sharing under s115 CDA cannot take place unless the obligations under
DPA98 have been met. And the information cannot be given to organisations
that are not "relevant authorities" without the explicit consent of the
individual.
Of course some data used for CDA would be aggregated and would not identify
individuals.
