I had to look at similar issues about transfer of data to unions in a former
life.
There seem to be two questions. The first is whether the unions want
information about all staff or only about union members. I would suggest
that the former is likely to be unacceptable as non-members will have no
concept of any relationship with the union and will not have consented,
either expressly or impliedly, to the transfer of any data.
Assuming it is members only, the second question is then what do the members
know about the transfer of data to the union? They may have already
consented to the transfer of certain information, e.g. details of the
payment of subscriptions. If the staff members don't know that details of
early retirement would be passed to the union then I don't think you should
hand it over. If the union can demonstrate some good reason for getting the
information from you as opposed to directly from the member, you might
consider getting members' consent (always assuming you know who they are) in
the future. An alternative would be to tell early retiring staff that they
should get in touch with the union and leave it up to them.
I agree that the staff timetable information sounds OK assuming you can't
identify anyone from it.

Subject: [data-protection] Release of data to TU's
We are seeking to establish recognition agreements with our TU's. Part of
the agreement will identify the data that the TU wants the college to pass
to them. Much of the data is general and non-personal but 2 items are, these
being (1)Names of staff being granted early retirement and (2)Access to
academic staff timetables.
I am reasonably happy about giving the info in point (2) but believe we
should not be passing the early retirement info to the TU.
Has anyone hit this one before (I am a new mwmbwer of the list so may have
missed earlier discussion)?
Your advice will be much appreciated.
