I completely agree with you there Roger.
It is perhaps unfortunate that specific philosophy is not general; Humanity
comes into play, and I suppose that is what provides DP practitioners with
the challenges which create such an interesting and challenging job. Sadly
the income does not often reflect those aspects of the role, humanity again?

Isn't it a valid view that by protecting the interests of data subjects the
DP practitioner
extends the confidence of the data subject to entrust the processing of
their personal data to that organisation. By processing their personal data
in a manner compatible to the good data handling principles of the DP Act,
the company would be maximising its potential for long term survival by
maintaining a good relationship with its customers who at the end of the day
pay the bills.
Or do those things only happen in a parallel universe.

Whilst out of order (off subject) for this group, this QC's message can be
related back to DP in the context of difficulties with draft legislative
frameworks, and was certainly worth the space it took. It particularly took
me back to the difficulties now being experienced with upholding the
principles supporting a data subjects rights, and confusions falling out of
principle one.
I am having some trouble in correlating it to DP practitioners though, and
perhaps the group could assist in my perceptions of this:-
The organisational structure of the QC's chambers and environment see strong
and constructive criticism as a culturally necessary aspect of their work.
The DP practitioners framework is most frequently set to be supportive of
the organisation, and it is generally culturally unacceptable to produce any
work which is seen to be against the interests of any strong groups within
the organisation. I suppose some solicitors working within organisations
have a similar difficulty.
Can this paradox be effectively dealt with by DP practitioners?
Or should they only ever support the organisational view at the expense of
the data subjects?
