I don't understand what is your concern here. Is it the status of the
evidence should it come to be submitted to court? Do you want to be sure
you are in a position to give the correct advice to people who undertake
such surveillance or do you have some role in this that I can't see?
surely a council has no responsibility in such a matter?

Paul, this is a growing problem!
Private individuals aren't required to notify re: CCTV under DPA and the
HRA & EU charter of fundamental rights is about the non-interference by
public authorities with an individual's right to privacy.
We have similar problems with tenants putting up CCTV cameras for home
security purposes potentially covering the public footpath and street. In a
couple of cases, we have individuals who train them at each others homes as
part of ongoing neighbour disputes!
In the past we've said that cameras must only pick up images of people
within their own boundary (see intro to CCTV code of practice. Also they
must comply with DP principles even though not required to notify because
of "family, domestic & personal" exemption, hoping principles 1 - 3 would
keep the potential excesses in check.
Following a recent conversation with a tenant I'm seeking clarification
from IC's office - apparently police told her none of DPA applied to home
use of CCTV and that she could film whoever / whatever she wanted.
