I would like your help and guidance on how I should handle and what is
required to be done for the following Education request before I release the
information. I have had some good advice from one of my fellow DPO colleague
who highlighted some issues I was not aware of dealing with Education.
We had a firm of solicitors representing a Mr. X, asking to see his
education files "pursuant to the Data Protection Act".
We have Mr. X's written authority to release them. The request came as Mr. X
who is likely to be making a claim against the authority concerning his
alleged lack of education (Dyslexia)
legal has seen the files (not a large one) and oked for them to be released.
I feel there is much more issues to look at.
Mr. X is asking to see his education files, I have been told there is
education files available from the education department maybe containing
special needs and admission etc. and education records maybe containing exam
results etc available from the School.
There is also the subject access fee for number of pages e.g. 1 to 19 page
£1 as stated in the compliance advice under subject access - education
records in England.
Before releasing we would have to ask proof of identity from Mr. X and a
letter of consent for the solicitors to obtain information
What type of proof would be required - driving licence, photo, passport,
address?
What specific information Mr. X requires from the education files
Do we have to obtain the age of Mr. X ?not sure for e.g. if required for
special needs etc
Any other important issues that would need to be considerd.
