Dear Pals and Tim,
1. I wonder why Data Protection Officers try to tackle a complicated
international legal issue as Transborder Data Flow and Privacy Protection -
the determination of the adequacy of legal and other arrangements should be
determined by the Country Data Protection Commissionaire ONLY. This concerns
all countries not only EU members.
To enlighten the members who wish to dig into the issue and understand the
mechanics and legal issues -

This is quite a through analysis for non-legal experts.
The legal Councillors should read the source documentation and study
International Chamber of Commerce solution of "safe harbour".
Yours

Gibraltar is a difficult one - I once tried to find out about it as I was
reviewing a subsidiary there in one of my previous incarnations. They do
have their own legislature, which largely echoes the UK. However they're
definitely outside the EEA, as are the Channel Islands and IoM.-

Isle of Man, and Gibraltar
Further to Gail's earlier question about EU approval for
countries other
than Switzerland and Hungary, does anyone have any
experience/thoughts
concerning transfers of personal data to British offshore
islands and
Gibraltar?
I know the Channel Islands and IoM have their own DP
authorities/regimes
(don't know about Gib)but am curious about how they are
regarded in respect
of the EU Directive and the 8th Principle.
All thoughts/comments will be most gratefully received.
