What purpose is your CCTV system used for?
What do your data subjects believe the data is used for and who it is
disclosed to?
That/those purposes and perceptions will determine to some extent to whom,
and how, data should be disclosed. Your organisations policy/procedure will
need to document the authority levels and methods for disclosure. e.g.
court order, DPA 1998 sect 29 exemption or straight disclosure, dependent on
the sensitivity of the data (as perceived by the data subjects).
Consider the recent media coverage of discussions at St Andrews University
over the privacy encroachments on students of a proposed TV programme, and
how that indicates the different perceptions of data subject v data
controller.
Any police officer should be happy to provide a form claiming a DPA 1998
section 29 exemption if they legitimately need to view a recording. If they
are not, I would question their reasons. Most police officers will normally
expect a responsibile CCTV operator to ask for an exemption form, (of course
if they are under pressure they may not like that, but that does not deny
the need).
