Having recently been doing some research around the monitoring of
traffic flows, I would like to pose a few questions to the group.
If an authority, say the police, capture my vehicle registration number
by a roadside camera, are they processing personal data? Given that it
becomes personal data when they combine the registration data with DVLA,
is it not then difficult to identify the data subject, who may be a
registered keeper but not the driver.
Secondly, if this authority introduces such a scheme, how can they
possibly provide ‘fair processing information’ at the point of data
capture. I will be speeding (not enforceably!) passed the data capture
device, which carries out all manner of data matching/processing all of
which I am unaware of. A breach of Principle 1?
I have looked at the various exemptions S.29 et al, but see a problem in
that the authorities cannot claim exemption from subject information
provision UNLESS they can show that it would prejudice the crime or
taxation purpose.
I don't believe I have been told adequately what the purpose of the data
collection is (and any unforeseen uses and disclosures), should I take
on the Government!
