Not an answer - more a sympathy statement!
I think this issue is one we all (in HE anyway) are having similar-type problems with at the moment. Same problem with accommodation staff/cleaners etc. e.g. True-life example: Student is not up until late p.m. (nothing new there I hear you cry!) but cleaner "just happens" to know she is diabetic and consequently saves life. Question of "duty of care" v balance etc. etc. We all probably have practices which, although not strictly "legal" have no workable alternative?
