If "misuse" of the list as defined in the recent discussions about
postings for marketing purposes is the concern here I do not see
this as a reason for making this a closed list.
In common with most of the lists I subscribe to, I use the delete
key more frequently on legitimate postings that are not of particular
interest to me personally than I do on "spam". More importantly as
has been said unless the list owner is going to be asked to vet
potential list members (an onerous task and what criteria would be
used?) spammers can just join the list, do their worst & leave again.
If on the other hand the concern is that discussion is being
hindered by members not wishing to publicly air their worries about
their own or others DP practices there may be a case for a closed
list. There is a parallel with the two copyright lists "copyrights" &
"ccopyseek" the latter being a closed list, however the criteria for
membership would still be interesting - would someone from the
OIC be welcome?
